Many of our clients will ask us whether they may be subject to surveillance during the pursuit a Workers Compensation claim. The answer is yes.
Many Employers and Insurance Companies hire investigators to conduct surveillance on injured workers. They do this to uncover any instances of fraud which may be apparent in the claimant’s Worker’s Compensation claim. Such investigators are naturally limited to where and when they can surveil the workers.
Accordingly, when you have been injured at work, tell your attorney any details regarding your physical capabilities and activities that may influence your Workers’ Compensation claim.
We also advise our clients to be aware that employers and insurance companies will regularly examine an injured worker’s social media accounts. The injured worker should afford requisite caution with their social media use while their claim is ongoing. One would want to avoid disclosing any material that could be interpreted in a way that could affect one’s Workers’ Compensation claim.
If you have been injured at work, and would like to receive an evaluation of your potential claim, please contact us as soon as possible.
